I think Hayne could have done more to avoid Goodwin, i.e. tried to hurdle him rather than just turning his knees away, however he didn't. It was careless on Hayne's part .. Grade 1 is justified and deserved. Gibbs' incident on the other hand was less careless and more malicious .. late and easy to avoid. He got grade 2, had carryover points and unsuccessfully appealed, hence his extended stint on the sideline.
So when it boils down to it, Hayne got Grade 1 and Gibbs got Grade 2 which is correct given the nature of the infringements. It is only their prior judiciary history and the appeal process which has resulted in seemingly disproportionate sentences.
