So if Foran has signed a contract with the Warriors which the NRL has not registered yet and the NRL turn around and reject him from being registered for salary cap or other reasons, havent they just opened themselves up to a Hopoate like lawsuit?
If due to salary cap would he be able to sue for breach of contract just like Hoppa did to us?
If due to him being caught up in match fixing/mental health issues would they be able to sue him?
Replies
time will tell, the nrl have no idea what going on..
I heard today he has sign for 3 years
Firstly, just because Foran has agreed to terms (an amount) with Warriors doesn't mean there is a written contract in existence. The Warriors have openly stated they have not filed a contract with the NRL and even if they do the NRL might reject the contract on the "notional value test" of Foran's perceived worth, let alone his mental state and connections to unsavoury people.
Hoppas lawsuit is very different to Foran in that our club offered a contract to Hoppa, Hoppa accepted the contract and then our board reneged on the deal sometime later (I would have sued as well).
The NRL have an over arching Duty of Care (Common Law Negligence) to Foran in that they don't want to see him return to his chosen employment and then days/weeks or months later see him commit suicide due to the stress of the game itself. The NRL "will not" registered a contract for Foran without Foran's Psychiatrist putting pen to paper to say Foran is psychologically fit and well to play the game. The NRL might (should in my opinion) make Foran go to a Psychiatrist of their choice as well to assess Foran before making a decision on his mental health (if they don't they are stupid).
The issue of alleged match fixing is just that - alleged, and he should be looked upon as innocent until and if proven otherwise.
