  • Its a very interesting topic Bazza. If i were to spread false rumours about someone, they could sue me for slander.

    If a witness lied under oath in court, you could go to jail for perjury and its a few years i believe.

    So if an accusation was made and proven false then they should be sued for slander and jailed for perjury.

    Very hard to prove though

  • Interestingly, the woman involved in this case (which is actually from 2013) was actually ordered to pay $US2.6m in damages. She originally was awarded $1.5m when she sued the school for not creating a safe environment.

    I'm going to use this as an opportunity to go off an tangential rant.

    I seriously don't know how the US functions. When you do a crime you go to jail, not pay someone else money. In a country with such massive class disparities, is it any wonder that you have this whole industry that exists on the basis of people suing other people. Its a system that creates untold discord and yet absolutely no value to its society. 

    The idea that money is a currency for affording justice or attributing punishment is so wrong on so many levels.

    It heavily slants the weight of a punishment based on how much money you have; it provides incentive to falsely accuse, because costs form part of the judgement it's upwardly self-perpetuating. 

    The only time a crime should involve money, is when money forms part of the crime.

    Punishment should be primarily repaid via community service. Your crime presumably negatively impacted the community, so you should have to give back positively to the community. Justice should not be a profit centre.

      i will say I can't wait til the football starts , all these blogs lately seem to serve division. Males against females , culture against culture....so repetitive and just an opportunity for SOME people to spew their bias ...

      my dream blogs are better than these - sigh

    • Phil, you’re correct in general, but you’re overlooking one thing. How would community service the woman who lied help the guy imprisoned because of her lie? The compensation addresses his loss. 

      Of course maybe the bigger picture here is that the US how downloaded so many of its social services that it makes it a fait accompli the wrongly accused will have to be compensated by the perpetrator not the State

    • There is a charge in Australia for obtaining financial gain through deception or fraud which this case would definitely fall under due to her suing the school. Not sure bout US though
