ROAR, David Lord at it again.

Over at the roar, David Lord is at it again posting a shorter blurb, however a couple of replies may not be to his liking even the one my pseudo posted but, the one under the link to lord's article is to me a great reply, methinks there is a continuation of people starting to see things as they really are without a form of too much eels bias.

The Parra 5 simply got an injunction.
Similar to how someone can get an injunction to stop the media presenting a story. If, on face value, the points you present have enough basis at law, then the judge will hand down the immediate injunction and a date is set for further hearing.

What Greenburg and the NRL did was roll the dice that pressure would force the Parra 5 to offer resignations. There was never a legal basis for the NRL to demand that another corporation terminate directors and staff. Given only the board sacks a CEO and the CEO and board are the ones who can sack the Football Director and only the members vote out directors (unless a statutory body forces removal); without the resignations how was the removal of staff going to happen when everyone who can pull the trigger on each other are implicated? 

All the injunction does is give the Parra 5 breathing room. 

What the NRL should have done is handed down the non contestable penalties that would apply IE points loss and fines.
At the same time the Parra 5 should have been given show cause notices as to why they should not be deregistered by the NRL. That hearing should have been in a few weeks.
The Parra 5 should have been working on their legal defence against NRL derigistration this week. 

The inclusion of the threat to withhold points for as long as the individuals were still working at the club was a play that, if it went to plan, would have quickly wrapped things up in a nice bow. It didn't work. So now plan B.  

Now the NRL will go down the other path that was always a possibility. The salary cap breach penalty of points and monetary penalty still stands. As does the required remedial action within 10 days to show the current squad is within the salary cap requirements. Unless Parra ask for a receive an extension (likely would be granted to show fairness in case of an appeal.)

While all this goes on there will be more and more leaks of damning information to the media to show the Parra 5 as complicit and remaining in their roles at the club untenable. A Parra members legal action could be the next step to force removal of directors with ASIC involvement possible.
Now there seems to be evidence of breaches of corporate governance and even illegal activity rather than rumour...

  • The roar is nothing but a moderated blogging site. Anybody can submit an article and if deemed worthy, it gets published.

    • Not exactly Yobz.  When you join the site & I have found it worthwhile, you go on a moderation time, based on the number of posts you put in.

      I have put some posts in that were pretty hard & suffered no problems in moderation but those who are also members can give you a rough time though.  What they do is hit at things that are defamatory & the like. Once you have posted enough you go on without a problem.

    • Sorry I meant moderated as in the original articles submitted are reviewed and decided upon before being published, and that not all articles get published.
  • Possibly right as sites such as this have to ensure that there is noting said that can be put back onto the site owners.

    Confidentiality may have something to do with seward and Greenberg being friends and worked together during bulldogs cap mess.  Seward actually contacted Greenberg for advice before speaking to nrl and also in evidence of meeting minutes it on record Seward had asked Greenberg for advice on how work tpa contracts in 2013 or 2014.  With that history any suprise nrl doesn't want evidence public
