Consorting with criminals

Just a quick question for any legal buffs out there. When the nrl wanted to put the draft in it was denied due to players citing restriction of trade. Even though it is the nrls competition this still stood up. My question is, with all the commotion about consorting with criminal figures could the players say the nrl is infringing on their freedom of association rights? I mean the nrl integrity commission have the power to suspend players due to this? I don't know the answer but it crossed my mind and wondered if anyone knew the specifics around this?

  • The Terry Hill legal case stopped the Draft a number of years ago.  Legally (at Law) you cannot restrict a person to earn and prevent them from earning if they have the ability to earn more (this is why the at arms length TPA's has no limit).  Other sporting codes have player drafts and restrictions on salaries because their respective players Unions (Associations) have agreed to have these for the benefit of that sport.  The NRL have the power to suspend, deregister players for a wide range of things.  The NRL give clubs a Licence to compete and this Licence can be revoked by the NRL.  In Layman's terms the NRL is a quasi-employer of each and every player and can stop a player from playing the game.  The NRL breach players generally under their wide reaching internal rule of "bringing the game into disrepute".  If clubs don't sack players or punish their own staff for off field incidents then NRL will come over the top and hand down harder punishment (ie., the Pearce matter in a prime example).

  • This is why we lost 12 points. NRL is not going to accept this and a few of our players were connected to some bad people.
    • You are right.  In short, the NRL are the boss and players play the game via invitation and this invitation can be taken away by the NRL, if players do the wrong thing in their own private time, and that is how it should be.
