One thing that does not make sense is that she stole a pair of his undies.
If you had been raped and left alone in the rapists Home/room would you go to his undies draw and steal a pair of undies as evidence or would you call the police or take out your phone and take some photos of identifying objects.
Sounds more like someone stealing a Souvenir as a momento or saleable item
ME I know your a lawyer and appreciate the US is not your specialty, but does the case have to have a certain merit or can anyone raise a civil suit in America regardless of the action.
