Section 12: She passed out & has no idea how she got into his house.Next thing she remembers is being in a bedroom & recognizing the silhouette of a man with the defendant's build coming towards her  (the same man she had minimal interaction with at the club earlier & when mostly in the public eye wears some form of protective padding)
Section 13: Defendant instructed no kissing and she recognized his voice as the defendant. (By him saying 2 words & the same man she had minimal interaction with)

  • One thing that does not make sense is that she stole a pair of his undies.

    If you had been raped and left alone in the rapists Home/room would you go to his undies draw and steal a pair of undies as evidence or would you call the police or take out your phone and take some photos of identifying objects.

    Sounds more like someone stealing a Souvenir as a momento or saleable item

  • The ‘no kissing’ thing is meant to reinforce a that claim of ‘gender violence’ which suggests a sort of abuse of power and gender inequality. If she has very little recollection how does she remember those words so clearly? Did she attempt to kiss him indicating she was a little more with it than the rest of the pleading seem to indicate?
    • ME I know your a lawyer and appreciate the US is not your specialty, but does the case have to have a certain merit or can anyone raise a civil suit in America regardless of the action.

    • In a civil claim, in Australia a lawyer just has to consider whether a claim has reasonable prospects of success before issuing a claim. Most lawyers don’t even do that. Sure the US is probably worse. In short you can issue any claim really and it’s up to the court to dispose of it if it’s frivilous
